These Terms & Conditions ("Terms") govern your use of the websites and services at surveyornotes.uk and surveyor.directory (together, the "Service"), operated by Apaqco Ltd, trading as SurveyorNotes.uk and Surveyor.Directory ("we", "us", "our"), a company registered in England and Wales (company number 07872761), address TAP, 70 Grange Road, East Wirral, CH41 5FE.
By accessing or using the Service you agree to these Terms. If you do not agree, you must not use the Service.
1. The Service
We provide property research, due-diligence, and reporting tools for surveyors and property professionals across our websites surveyornotes.uk and surveyor.directory. The Service aggregates data from multiple public registers and third-party sources and presents it alongside tools, calculators, directory listings, and report-generation features.
2. Accounts
- Accounts are for use by a single named individual only. Sharing accounts or login credentials is strictly prohibited.
- You are responsible for keeping your credentials confidential and for all activity under your account.
- You must provide accurate registration information and keep it up to date.
- We may suspend or terminate accounts that breach these Terms.
3. Acceptable use
You must not:
- Use automated scraping, scripts, robots, or bulk-extraction tools against the Service;
- Attempt to circumvent fair-usage limits, rate limits, or access controls;
- Interfere with the security or integrity of the Service, or introduce malware;
- Use the Service for any unlawful purpose.
We operate a fair-usage policy to ensure equitable access for all users and may limit or suspend usage that is excessive or abusive.
4. Data, accuracy, and professional use
- Data is drawn from multiple third-party and public sources. We do not guarantee that any data point is accurate, complete, current, or will remain available, and we may add or withdraw data points at any time.
- Tools, calculators, and generated reports are provided as a starting point only. You must independently investigate, verify, proof-read, and confirm the accuracy of any output before relying on or using it.
- We do not provide professional surveying, legal, valuation, or financial advice. You remain responsible for your own professional judgement and should consult an appropriate professional where needed.
5. Use of data and intellectual property
- All content and compiled data on the Service is protected by copyright and other intellectual-property rights, reserved by us and our data suppliers.
- Subject to these Terms and your subscription, you may use data from the Service in any lawful way for commercial or non-commercial purposes.
- You may not publish, sell, license, distribute, or otherwise commercially exploit data from the Service — as a product or service consisting substantially of unenhanced Service data — in competition with or substitution for the Service.
- Paying subscribers may use screenshots, extracts, or PDF downloads for legitimate purposes, provided they are unmodified and the source is acknowledged.
- Underlying public-register data (for example, EPC, HM Land Registry, planning, and other data) is supplied under the licences of the originating bodies. You must comply with the terms of those licences, including any attribution requirements, when using such data.
6. Subscriptions, credits, and payment
- Access to certain features requires a paid subscription or credits.
- Fees, billing periods, and any credit allowances are as set out at the point of purchase.
- You may cancel at any time. Cancellation stops future renewals and takes effect at the end of your current paid period; you retain access until then.
- Fees already paid are non-refundable, and we do not provide partial or pro-rata refunds for unused time, except where a refund is required by law.
- We may change pricing on reasonable notice.
7. Data protection
We process personal data in accordance with our Privacy Policy, which forms part of these Terms and applies to both surveyornotes.uk and surveyor.directory. In summary:
- We are the data controller for your account data and for the property/public-register data we aggregate and present.
- We use sub-processors under contracts requiring equivalent safeguards, and apply appropriate technical and organisational security measures.
8. Surveyor.Directory — listings, AI content, and reviews
This section applies to the surveyor.directory website.
8.1 Directory listings
Surveyor.Directory displays listings of surveying firms and professionals, compiled from publicly available information and from listings that firms submit or are invited to provide. Inclusion in the directory does not constitute an endorsement, recommendation, accreditation, or verification of any firm by us.
8.2 AI-generated descriptions
Listing descriptions are generated using AI from publicly available information and may contain inaccuracies or be out of date. They are provided for general information only and must not be relied upon as a statement of fact about any firm. We give no warranty as to their accuracy or completeness.
8.3 Corrections and removal (delisting)
If you are a listed firm or individual (or act for one), you may at any time and free of charge ask us to correct your listing or to remove it entirely. We will action valid correction and delisting requests promptly. Requests can be made via the contact route on surveyor.directory or by emailing [email protected].
8.4 Reviews and user-generated content
Where the Service allows you to submit reviews or other content about a firm, you agree that:
- your review is your honest opinion, based on genuine first-hand experience;
- you will not post content that is false, misleading, defamatory, abusive, harassing, discriminatory, infringing, or otherwise unlawful;
- you will not post fake, incentivised, or conflicted reviews (including reviews of your own firm or a competitor);
- you own or have the right to submit the content, and you grant us a non-exclusive, royalty-free licence to publish, edit, format, and remove it;
- you will provide proof of a genuine client relationship when asked (see Section 8.5).
Reviews are moderated before publication. We are not obliged to publish any review and may decline, edit, or remove any review or other content at our discretion. You are solely responsible for the content you submit.
8.5 Review verification (proof of genuine client relationship)
To help ensure reviews are genuine, we require reviewers to verify that they were a client of the firm being reviewed by submitting an image of an invoice from that firm. By submitting an invoice you confirm it is genuine and relates to services you received.
- A review will only be published once it has been verified and moderated. If you do not supply a valid invoice, your review will not be published.
- Please redact any information not needed for verification — we only need to see the firm's name/identity, the date, and that the invoice was issued to you. You do not need to disclose amounts or other parties' details.
- We use the invoice only to verify the review. It is not published and is not used for any other purpose.
- We retain the invoice image only for as long as the related review is published, and delete it when the review is removed.
8.6 Objections, complaints, and right of reply
A listed firm may request a right of reply to a review, or ask us to remove a review or listing content it believes is inaccurate or unlawful. A firm may also object that an invoice supporting a review is not genuinely theirs. In that case we will remove the review pending a check of the invoice, and reinstate it only if the invoice is shown to be genuine. We will assess all such requests promptly. 9. Disclaimers and limitation of liability
- The Service is provided "as is" and "as available". To the fullest extent permitted by law, we exclude all implied warranties.
- We are not liable for indirect, special, or consequential loss, loss of profits, business interruption, loss of data, or reputational harm.
- We are not liable for loss caused by viruses, denial-of-service attacks, or other harmful material resulting from your use of the Service or any linked site.
- Nothing in these Terms excludes or limits liability that cannot be excluded by law (including for death or personal injury caused by negligence, or for fraud).
- Subject to the above, our total aggregate liability arising from the Service is limited to the total fees you paid to us in the 12 months preceding the claim.
10. Suspension and termination
We may suspend or terminate your access if you breach these Terms. You may cancel your account at any time. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.
11. Changes to these Terms
We may update these Terms from time to time. The current version is always available on our website. Continued use of the Service after changes take effect constitutes acceptance.
12. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
